Affirmative covenants are actions a borrower agrees to take while a loan is outstanding, such as delivering various financial statements at set periods, maintaining insurance, paying taxes and complying with laws. Failing to meet an affirmative covenant can trigger a default which, if not cured or otherwise waived, can result in an Event of Default under the credit agreement. Frequently, affirmative covenants for the delivery of financial documents often align with financial covenants and the financial documents become the basis for making the financial calculations in those covenants.
